Dear Sir/Madam, I want to know that the giving termination letter without any notice period is legal or not.
Without any prior notice the company pressurised to put papers and when it was not done they gave termination letter with false reasons like high ended behaviour, attitude problem etc which was not discussed & were being discussed before giving the termination letter.
This is the total injustice done to an employee who was working there since last 2.5 yrs, so the client wasnt to fight for the justice, could you pls suggest ?

Termination letter giving to employee without prior notice could be legal if organisation paying wages for notice period as per defined on contract letter or their standing order or model standing order.
If no wages paid,send a letter thru registered letter/post,email copy from your personal mail id,or take a copy with receipt of manager in charges or organisation of your letter stating the what is the reason of termination,they will prove it otherwise(if they failed to prove) organisation is liable to pay notice period wages including gratuity amount or other benefits and penalty can be imposed if you take this matter with labour court.

I was working in a reputed card rental company in Park Street, Kolkata since Aug2007. On last 06-Aug-2012, all of a sudden the partners treminated me without any notice period rather than I was forced to sign on the resignation letter for the sake of my last month salary and the puja bonus. It is thier common attitude to all the employees and many others had faced the same thing. Moreover its found there is a mishap of Rs. 914.00 in my PF account which has been dedcuted from mu salary nut not yey deposited in my PF account. Now they are not willing to give any salary certificate nor the FORM 16.
Is there any legal action to be taken to stop this TALIBAN RULING of sudden termination and claim any compensation?
What to do with the mishap in claiming PF account.

you need to go through the employment agreement on termination clauses. Secondly, though termination is valid when compensation is paid or paying full salary including notice period, it makes it invalid if the reason arise on some one's behavioral problem, because the question of some one's career and profession is at stake. Hence, any management has no legal support to take such decision without hearing to the other party as hinders the natural justice of any employee and bad impact on other co-working employees. Hence, make sure that you demand for justification as to the statements made and also rise the question if behaviour was the main reason how could company was silent since more than 2years?!! Ofcourse, you can not demand for your job in the same company but you can demand for justification and compensation as well as clean records...... you may also claim for evidence supporting such vague statement on some one's pertaining to their impact on professional life.........

If the company has not issued the final termination of dismissal letter then they conduct the meeting regarding the same in time being to discuss in person, so also make sure about this.......

If the company fails to prove the genuine case of misbehaviour you may not only claim for full salary but also may claim for full support until you get a new job or their support to get you a new job...........
