One of My good friend was working in a Pharma company. In meeting there was heated discussion and MD told my friend today is our last day.
And my friend did not send the mail about the discussion with MD and did not mail HR. HR was present during this discussion.
As my friend did not send the mail. He did not go to office , but handed over all the company property ( Laptop . ID card etc etc )
But he did not return the car . He has mentioned in the mail that he would purchase the car from the company.
After a month HR sends him mail stating that since you have not given the notice they would deduct the 3 months Basic salary.
Still they have not settled the accounts. Nor they have sent any communication after that.
Please suggest that how do my friend gets back in F & F without any deductions.

Hello there,
It is your friend mistake only, when employee leaves from the company with or with out serve notice period, they have to submit the resignation letter or mail copy, in youe friend case, there is no return statement to leave the company from employer to employee or resignation letter from employee to employer, so employer thinks that the employee has been absconded (Even though the company said to go) because of no statement as per policy, the company said is right
only chance is tell your friend to write an e-mail to HR and cc to MD stating the issue has happened and the company ask his to leave the company and if you get the confirmation from them, then your friend is safe and fight for full F&F, if not as per company policy, they will deduct the same.
also tell your friend to complete the NOC, by telling handover laptop and kept the car is not valid for reasons, so complete his NOC and submit the resignation letter and get the acceptance then fight for F&f

Do not take decision in a haste. Ask your friend to go and meet the management and settle the things by sitting across the table instead of scoring brownies. It is not good for anyone in a senior position[which I believe your friend is] to take decision at the spur of the moment and that too in a negative manner. Decisions taken when in mood swings or in emotion are bound to be disastrous,
There is nothing to lose if he personally settles the issue, either way, including the settlement of accounts along with the car.
There has to be documentation in issues like resignation wherein notice period and handing over plays a vital part subsequently followed by the full and final settlement of accounts including whatever the employee possess but which belongs to the company. Remember your friend needs relieving letter for employment elsewhere. Company has to decide whether to sell the car or not, not the employee. He is not doing any favour by retaining it and wanting to buy.
Hopefully things might have settled down in the minds of the people by now or at least subsided to a great extent and they can talk it out instead of acting like teenagers.

Unnecessary Egos...once there was quarrel happened with management and decided to go out ...ur friend has to communicate and follow all norms of company laid for resignation formulas.
See company is more great than any.... It is permanent .people may come and go...Administration is permanent. So follow norms pls and don't invite troubles. You are dealing with a company not any individual differed you..so no regrets.Follow as usual.
Asking the company car for purchase ...silly .childish..provocative ...quaralative temper showing...

Pls go to ur company talk smoothly and directly upolozise all mistakes done.condusive compromised manner u follow there..
Even though ur grivabce is not heard by management then we should prefer legal approach ok

Dear Colleagues,
I beg to differ with the views expressed above.
MD has asked your friend to leave following heated discussion. It is the MD's decision to terminate his services and notice or notice pay has to be complied by the company. There is no question of resignation by your friend and no notice is required as it is not his action.
Your friend should go on record stating the sequence of events leading to MD' s decision asking him to leave. Also mention that he continues in the service until communicated otherwise.
Hold on to the car and skilfully bargain for full and final settlement and smooth separation in lieu of return of the car .

Sir.I agree with Agarkarji.
.My suggestion is also in the same line. There is clear communication gap.Once anger heated temper may be be cooled down later.MD may take back his decision.We don't know what your friend as employee told in that quarrel.Irritated MD or Employee may loose temper and may speak any.laterday they may change opinions
No one want to loose experience d employee and vice versa
So that I suggested employee has to approach management another day with light er mood
