My query is that can principal Employer issue Form III to Sub contractor, if contract is between Contractor and Sub Contractor , no contract between PE & Sub Contractor so labour Department is Asking to Enclosed Work Order copy with application.
Following Queries:-
1. Can work order copy given by Contractor shall be enclosed or issue new work order by PE.
2. Contractor is having only 06 employees so no need to take labour license. Shall Statutory Compliance will be maintain by Sub Contractor i.e PF, CLA Registers etc.
All members are invited to please enlighten me the above query.

Form III is for registration of the establishment as Principal Employer. Form V is needed from Principal employer (PE) for the Contractor to get license. As correctly mentioned, since the number of labour deployed is below 20, there is no need to take Labour License by that party.
1. The sub contractor already has got the work order from the contractor. PE shall never issue another work order for the same purpose.
2. Yes, the compliance has to be ensured by the Sub-contractor. But as PE you are also liable in case the contractor defaults. So it is in your interest that the Contractor shall get the establishment checked by the respective authorities at least once a year.
