Sir, There is no scope of any personal option in the provisions of ESI Act, 1948 and rules/regulations framed thereunder.

Dear Nagraj ,
There is no any provision of ESI contribution , if the gross salary is more than 15000 . In another words they are not eligible . Although the ceiling is supposed to be increased from 15000 to 25000 soon.

Dear Nagraj,
There is no provision for availing the ESIC Benefits if the Gross Salary (not to include OT) is above Rs. 15000/-. If the gross salary - OT is above 15,000 than he is not eligible for ESIC Benefits.

Dear all ,
I agree with the views expressed by my fellow brothers.
A person employed in factory /establishment which is covered under the ESI Act and drawing salary /wages more than prescribed limits are termed excluded employees hence not eligible for coverage even though the employee is willing.Because coverage is not at the option of the employee but on the ceiling limit of salary /wages prescribed.

Dear All,
An employees drawing his gross salary more than 15k is not at all eligible for ESIC benefit but yes soon the ESIC limit is going to be increased and will reach upto 25k gross per month.

No, there is no such provision under ESI act to cover employees drawing salary less than 15,000/- But any employee who is physically disable & drawing salary less than 25000/- but more than 15000/- is coverable under ESI act.

Dear All,
My reply is as under in this matter,
Any employee is willing to enroll as ESI member even though his gross salary is more than 15,000/- Pm, he can request the management to cover under ESI, if management is willing to bare the employer the employer contributions can pay to ESI deducting employee contribution up to Rs,15,000/- only .i.e
Example: on e employee salary is 30,000/- employee and employer ESI contributions to pay up to Rs,15,000/- only.

1.I feel that the information as furnished by you in your comments as above is wrong and baseless. There is no system of optional coverage under ESI Act, 1948 and rules/regulations framed thereunder.
2. I hope, you will consult the above Act/rules/regulations and if I am wrong, I hope you will mention the provisions of said Act/rules/regulations so that I may be able to correct myself.
3. Furnishing of wrong information in this CiteHR, I feel, will lead to misguiding a large number of viewers and I hope, you will clarify the correct position in your comments by indicating provisions of Act/rules/regulations as above.
4. I may also further inform for your kind information that wrong coverage of any person under ESI Act, 1948 and making him entitled for benefits (to which he is/was not entitled) is an offence punishable under section 84 of said Act (punishable both for covered person as well as employer).
