I am working in one IT company as I am handling HR I have a query that there is one employee who is not performing well from quite a long time & my boss wants to terminate him.
Please guide me with the Termination letter, process to do that & information regarding his payment i.e. whether to give him notice pay or what else.

Send a notice to his residence asking him to report within a specific time and mention failing which he will automatically stand terminated from that date.
And wait for the reply....in case of no reply send a termination letter on the date he stands terminated and settle his F & F.

We agree with the issue but in any case a notice i.e a show cause notice shall be given stating the facts:
1. Reasons for the continued and unauthorised absense.
2. Such act causes lose of work, revenue, project delays and further scheduling of the projects
3. Time limit of resonding the show cause notice
4. Termination if not joined and further actions.
In case the employee did not turn up, you may discharge him from the services with immediate effect.

Hello Seniors,

One of my employee has availed option to work from home in july this year and in Sept that employee did not work and was on sick leave. No written communication is recorded but verbally notified to the respective manager by the employee.
Now that employee has requested LWP for 1 year as doctor has not recommended to work and that employee want to retain the job.
Employee do not want to resign. In this can can we issue termination letter as we can not afford someone to be LWP for 1 year and then drop back to work.
May I know how and what do I mention in the letter as we do not want to get into legal consequences. We are under shop and Establishment act Maharashtra. (we are marketing services industry)
It is bit urgent. Would be greatful if someone can reply me appropriately for my query.
