I joined this company last month on July 15. On August 31, they are asking me to leave the job without any specific reason. They neither gave me any prior notice nor asked for a resignation. Please help me with what actions I can take against them.

What is your location? You can take legal action against the company with the help of an employment lawyer.

goto labour office in your city, they issue legal notice to that firm. and please ansure that you must carry all documentation between you and your company

Dear Sonu,

What has been written in your appointment letter regarding your relieving in the probation period? Is there any other issue that you have not highlighted? Going to the labor court is easy, but if the management can prove that the termination is legal, do you have proof to counter them? Think rationally. If the ouster is based on some paperwork, be extra careful.

They have not given any notice, neither said anything about it orally. Even they did not have any problem with my work, as said by the CEO. When I asked him the reason, he did not give any reason and asked me to discontinue the job from the next day itself.

As pointed out by Ashutosh, the Terms & Conditions of the Appointment are important. During the Probation Period, which is 3 to 6 months in most companies, the company reserves the right to terminate without specifying a reason. Moreover, if the appointment states that the position is purely temporary and a specific period is mentioned in the Appointment Letter, then there is no legal or moral choice but to exit. For example, if you are appointed to cover a position due to Maternity Leave, then the post is evidently temporary.

In other words, the position to which you are appointed should not be of a casual/temporary nature, and you should have served for a minimum of 120 days (6 months) for the Labor Commissioner to be convinced that the position was not temporary. On the contrary, if the position is permanent, but you have worked less than the minimum 120 days, you still risk losing it. My explanation above should clarify where you stand.

You haven't mentioned your designation or department. Please let me know who asked you to resign. Go and talk to your senior management, and refer to your appointment letter. During your induction, they must have mentioned the company's policy. Refer to the termination policy and discuss the matter with your top management.
