I work in NIELIT, an autonomous body but under govt. Of india ( ministry of electronics and information technology). I have been working in this organisation for last 15 months as a contractual employee with a consolidated pay. There are many centres of NIELIT all over india but my centre has less than 10 employee. Will i get maternity benefits. If not, is there any way to get such benefits.

1. Dear member, I think, the query you raised is not having complete information on the subject. There are so many issues like (a) what are terms and conditions of your employment (b) how many numbers of employees on contract basis are working in the centre through your contractor and how many regular employees are working in the centre employed by CPSU (c) what is the position with reference to applicability of various labour laws to the contract employees working in the centre (d) whether contract employees are covered under ESI Act, 1948 etc. etc. ?
2. In addition, question will also arise whether any woman employee working through contractor in the centre has been denied maternity benefit by the contractor as well as by CPSU ?

Are you directly working under NIELIT. Who is your Principal Employer? Who is your Contractor, what is your Consolidated salary, are there statutory deductions like PF, ESI, PT? WHO IS PAYING SALARY? Submit your Maternity claim to your Employer with out worrying about 10 Employees requirement.
