Need your help I would like to know about Standing Order applicable to which companies? We are basically just started IT company in Gujarat with 10 employees . Help me out how to draft standing order or any sample available. Thank you in advance

Dear Colleague,
The standing orders act applies to the establishment employing 100 workers (In Maharashtra 50 workers).
Since you are engaging only 10 employees, this Act does not apply to you.
But you can still use the model standing orders as a guiding principles for workers to follow for day to day working .

You should need 50 to100 & more employees to submit standing order act.

With the consolidation of several labour legislations into codes, the Industrial Employment (Standing Orders) Act, 1946 got subsumed into the Industrial Relations Code, 2020 ("IR Code"). IR Code, under Section 29, confers powers on the Central Government to make Model Standing Orders ("MSO") relating to conditions of service and other incidental matters. MSO shall be applicable to all industrial establishments employing 300 or more workers

It has also been specified that if the employer adopts the MSO, then such MSO shall be deemed to be certified. This is a simpler route for certification of the Standing Order which the employer can opt for. Presumably, the longer route of certification of the Standing Order can be avoided by adopting MSO.

However I suggest, for IT industry, for clarity and consistency, and to reduce potential liability, it’s important for complete conditions of employment to be written down and made available to every employee, either in the form job role or employee handbook or company policy manuals, from the beginning
