Dear Friends,
Iam working as production manager for one of the manufacturing company in Bangalore since 2008, i have submitted my resignation 2 days back & iam reporting to the managing director
He is not accepting my resignation & refusing to release me, as per the employment agreement i need to serve 1 month notice period which iam ready to serve and not agreeing the relieve me.
iam also not getting any response form the HR department also since HR dept is coming under him.
please help & guide me to overcome this situation.

Let's look @ your situation from a DIFFERENT ANGLE/WAY.
1] Why did you resign? Was it for better prospects [designation and/or salary] OR did you have any problems/issues in the company that forced you to look outside?
2] What were the reasons the MD gave to refuse acceptance?
IF your resignation was purely for better career prospects AND you didn't have any problem(s) with the MD or others in the company AND your MD doesn't want to leave you since he thinks that you are too valuable, MAYBE you can cut a 'deal' with your MD? Just give this a thought.

Actually the problem is our MD is a crazy person & he wants us to work hard in result we are working around 60 hours min in a week he don't consider our personal problems.
Also we do not have any fringe benefits for employees including provident fund which is paying with the minimum cap.
Understanding his character if i reconsider my decision iam 100% sure he will trouble me in future.
Hence iam not having any interest to continue my services.
please suggest me how can i solve this issue with the relieving letter.

In case you have sent the resignation through email, list down all you activities in a handing over format. On the last day send him an email with details of handing over and state in the mail with reference to the resignation letter that you have served the requisite notice period and to send your relieving and settlement to you.
Since you say that its an unorganised organisation, I doubt whether the settlement or relieving order will come. But, have copies of emails in which your resignation is mentioned and also please the last date of working and keep it as record.
Nothing much can be done when you have such difficult and crazy people as MD.

My Last working date with the organisation will be ------------. You are hereby informed to take all the handovers on or before my last working date mentioned herein above. You are hereby also requested to kindly remit all the dues pending within 30 days of my last working day as per the statutory norms to avoid any legal hassles
Any unlawful demands after my resignation acceptance will be termed NIL & nullified. You are requested to kindly accept my resignation in writing within 3 days of my tender. Failure which will be deemed as accepted.
You are lastly requested to co operate me for a smooth exit.

I request you to kindly treat this mail as a mail of resignation and as per the policy, relieve me on .....(date) completion of the notice period.
I would highly appreciate if you could kindly release my full and final settlement on my last working day. This kind gesture of yours would be of great help for me.
I once again thank you for all the support given to me during my tenure.

Even if you have any animosity against your so called crazy MD, please do not show it in your letter. You be polite. You must understand that currently he is under control of a role which ensures that your final dues and also the final relieving certificates etc have to be issued. Do not sabotage those things. Send in this polite mail. Mark a bcc to your private mail and keep it as a copy. Try to be polite and low profile and silently leave without causing any ripples. Your ultimate aim is to get out and join the new place. Keep that in mind.
