I am working as a software engineer from past 2 years for a small size software company.I had signed an offer letter with 1 year duration.At present offer letter is expired as its 2years since i am employeed to that company.I was recently involved in a project(but didnt not sign any papers).I gave resignation as i got an offer from other company, my relieving period is 30 days as in offer letter but company management is telling they will inform me how many months i need to work(as they say),they have my original marks cards,can i break the notice period? .Please help me what i can do to get out of this problem

As you completed the minimum 1 year of service with the company you can leave the company as per the company policies. I think they want to retain you as you were involved in a project (i think they want to relieve you once that project has completed). You can request the hr about the reason why they are asking to work for more days ( actually the notice period is 30 days) accordingly you can take the decision. Don't take any wrong decision ( absconding or something) it will give bad impact to your career. They may not give your certificates and experience letter if you do the same.

Why have you submitted your original education certificates? It should only be shown for verification and returned back to employee. In the eventuality of some fire breaking out or records destroyed, will your HR arrange to get a duplicate education certificate and marksheets form the university? Its a regressive practice in my opinion.
As regards your issue, you should speak to your HR asking them you want your original certificates back for re-applying for passport (Or some other reason). Once you get these, do not give it back to your company.
Then negotiate with your manager on the final date. You are ready to serve notice, so they should not officially hold you back beyond it. All the best!!
