I was asked to leave my last organisation 46 days back and as I was yet not a permanent employee they didnt provide me any reason, however they provided me with the Release Letter and also an email confirmation that I shall get my salary till last working day after the expiry of 45 Days from the day of my forced release. Its 46 Days now and I didnt get my salary. I sent them 2 emails to release my salary within 24hrs window but no response from them.
Kindly suggest how I should proceed to get my salary from them, I am ready to even file a Legal Suit if required. This is a small Call Center. in Kolkata and I was working there as a Process Trainer.

Dear friend,
You have not written that for how many days did you work and for how many days the payment of salary is outstanding. You are liable to get salary till your last working day.
Sufficient time has been lapsed since your exit from the company. I recommend you approaching labour officer of your area. Carry along with you sufficient proof of your employment. Talk to him and give him written application on non-payment of salary. On the strength of your letter, labour officer will liaise with the company authorities and try to settle the issue. If the issue is not settled then only you follow a course of litigation.

Thanks for the information. I joined this company on 6th Aug 2014 and they asked me to leave the organisation on 27th Sep 2014 saying that as they dont have Training Batch so they dont need a Trainer.
They provided me my Aug salary on 20th Sep 2014, as the first salary they after 45 days and their salary cycle is from 1st to 31st of every month.
They sent me my Release Letter on 1st Oct 2014 and confirmed that they shall pay my salary from 1st Sep 2014 till My last working day which is 27th Sep 2014.
Cant I ask for one month more compensation from them as they asked me to leave without letting me serve one month notic period. If you want I can send you my Offer Letter so you can go through the Clause of it if you want.

Dear friend,
From your latest post, it emerges that payment for your salary is due from 1st to 27th Sep 2014. They should have cleared your dues at the time of exit or at the time of disbursement of salary for Sep 2014 or sometime later. Still they have not done that.
Continue your correspondence with them. Go and meet them personally. If nothing works then only approach the labour officer of your area. Try to resolve the issue amicably.
As far as one month notice pay is concerned, you need to check the clauses of the appointment letter. Possibly you were on probation. During probation period company, can remove you with short or even shortest notice. Nevertheless, at this juncture the most important thing for you is to recover the salary for the actual period you have worked. Recovery of notice pay, even if you are eligible for that, comes next.
