The maximum wage limit for the calculation of compensation under the EC Act, 1923 stands revised from Rs. 8000-00 to Rs. 15000-00 w.e.f. 03-01-2020 via the Ministry of Labor and Employment Notification S.O. 71(4) dated 03-01-2020.

The Maharashtra Shops and Establishment Act, 1948 makes it mandatory to keep an attendance register at the reception, and employees must sign in and record their time in the register. With 35 employees, we are currently using biometric attendance.

Please advise me on labor laws similar to the one I have attached.

In such a case compensation under the ECA,1923 has to be calculated on the basis of Rs.12000/= or the statutory minimum wages whichever is higher.

Dear Sandeep,

Amount of Compensation:

A. Where death results from the injury: An amount equal to fifty per cent of the monthly wages of the deceased employee multiplied by the relevant factor (Copy of factors for working attached) OR an amount of one lakh and twenty thousand rupees, whichever is higher.

B. Where permanent total disablement results from the injury: An amount equal to sixty per cent of the monthly wages of the injured employee multiplied by the relevant factor OR an amount of one lakh and forty thousand rupees, whichever is higher.

Suppose the age of the deceased is 40 years and the salary is 14,000/-. If 50% of the wages is Rs. 7,000 and 184.17 is the factor, then the compensation will be Rs. 12,89,190/-.
