Hello Sir/Madam,
I am working in Komatsu India as a Asst.Manager in service support.
Normally we hire man power on contractual basis from Chennai. Now we have planned job at Tata Motors plant. But our customer is asking about labor licence.
Can any body let me know what is difference between factory labor licence which issue by Factory inspector & Contract labor licence which issue by labor department.
Right now our sub contractor company stationed at Chennai & they have licence which was issue by inspectorate of factory under rule 4(6) of Tamilnadu factory rules 1950.
can he work on this licence as a contractual labor. please suggest.

Dear Sir,
Here You have Attached is Factory Licence not Labour Licence, which was issued to run the Factory. To engage the Contract Labour the Principal Employer will ask about the Contract Labour License. From above query i came to understand that you are going to engage some of your contract Labours to your Customer ( Tata Motors Plant). I need some clarification, whether you are going move your Contract Labours or your Company Employees to Tata Motors Plant? If You are going to move your Contract Labour means you may ask the Manpower Supplier who is supplying to you about Contract Labour Licence under The Contract Labour ( Regulation and Abolotion) Act 1970.

The facts understood is as below;
1. Your co got a contract with TATA Motors
2.You are sub contracting to some one else
In the above you should apply for a labour licence at the place i.e where the TATA Motors is located . You should ask Form V from your principle employer in order to apply for the same
You should verify with your su-contractor that he too should have a labour licence if the no of persons employed is above 20
if any further calrifications reply back

Dear Munish,
Further to the words of Gandhi Ji and Venkatkrishna Ji, I would like to inform you that, when you are going to provide contractual labour to any other organization as a contractor, and will have to deploy more than 20 contract labour at that site then you will have to take Labour License under Contract Labour Act. It should be applied at the Labour Office in whose ambit that location falls, where the contract labour will be deployed.
For this purpose, you will have to apply in Form- IV along with the copy of Contract Agreement, Form- V, Affidavits (diff. from state to state), etc.
Hope this will clear your query.

Dear Munish,
As per the contract labour act, we have to take registration certificate under CLRA Act if we are engaging more than 20 men power in a particular site/location in any one day of working days.For getting registration certificate ,we have to apply in FORM-IV along with FORM-V (which will be given by principle employer),work order and prescribed Fee to to labour office.
For any other clarifications please post query on the same.

Dear Mr PK Shrama,
First Congrats for New Assignment :
Now Kindly follow the following procedure :-
Since You will engage your manpower with Manufacturing Unit ,
Get Form - V from in favour of your firm from PE ie Owner or Manager of Botling Unit.
And after that take Labour Licence on that from ALC Office / Meruth ( UP).
Ensure PF & ESI Coverage alongwith Labour License and keep ur Work Order / Agreement
signed because its copy may be enclosed with Labour License.
Keep your manpower details update for verification by government Officials.
This is applicable if you are engaging manpower 20 or more daily for the said job.
