Dear Senior,
I went through several discussions regarding the same topic.
But to make myself clear i would like to put in my query in my own way.
I am working for an Electronic MNC for the past eight months. I was not assigned relevant work of my domain area and i don't have a person above me to moniter my work. Totally i'm dis-satisfied on the company's management. My confirmation was orally told, but serving further questions my future. So i decided to quit and now holding an offer. The management now demands three month notice. I have already served a month. I dont have work for three months and this notice will remove the other offer i have in hand. The technical panel has agreed that my presence here will not be needed for three months. Problem in convincing the HR Head. Is the contract signed in appointment letter so srong. Pl. Advice me. I just want a relieveing letter. No experience gained.

In this case whatever the notice period while on Probation period mentioned in your appointment letter is applicable to you as you do not have written confirmation letter from HR department.

It is three months from my side and zero from their side.
But the technical heads to whom i report (Taken granted myself) has agreed there is no scope for me even for the next two months.
Can they help me to get relaxation

Mr. Balaji, after going through your post and concern, I would like to suggest you to speak to your HR Head this regards without any hesitation and request him/her to relieve you early. I understand what you are going thru and not feeling good these days, but the solution of your problem is in hand of HR HEAD and im sure if you request him/her with a valid reason, will relieve you early. Also your Technical Panel has agreed and realized that your services are no more required by them, so there is no problem in talking to your HR Head. Also try to convince your Technical Head too..

Also I agree with Shaila. You still have no written confirmation, you can go for it but still have to serve notice period or have to pay for short of notice which will be deducted from your salary and I don’t think you’d have any problem in that…

Well about breach of Contract, we rarely see any legal action taken by Employers against any employee in this regards bcz Employer has no much time for this too, therefore don’t worry and speak to your HR Head.

Hey Dude, why are you feeling guilty, you have never done anything wrong or not going to do so...and also in your situation where you are not enjoying your work even not getting support by your team and by others seniors, you have have to think over this but with a valid reason if you have..there is no need to waste time bcz its a question of career and life..
See, Actually most peoples do think over resignation bcz of offering great package by others and present the false reasons for resignation and do make the excuse but in that case where one is not getting support and have no confirmation of job even after few months of completion of probation period, one have to think over this..and if you wanna get early relieve must speak to HR Head and convince him by humble request and with valid reason.
Surely he will help you in this regard..

The problem which I understood is that , U want to be releived and need relieving letter to join the new company.
Pl. write a mail to HR Head , CC to HOD , CEO and express your problem in right perspective and request to relieve accordingly.
Then PL. talk to your prospective Company HR Head and tell him the fact that the present employer is not issuing the relieving letter.
u have to take a call and put the things in right perspective.

I agree with Anil Arora--that you need to TALK with the HR Head.
I also suggest to AVOID putting your point-of-view IN WRITING at this point of time for 2 reasons:
1] The HR head may misunderstand that you are in the wrong & that's why you may be avoiding any F2F meeting.
2] You will get a chance to judge his/her responses across the table & handle the issue on the spot & then, if possible, resolve it.
I also suggest you to talk to your technical heads to put in a word on your behalf to the HR head-IN FRONT OF YOU [this will give you an indication whether they really mean what have been telling you so far--that you can go].
However, I fail to understand one thing in your case. You mentioned that the company is a MNC [irrespective of the field]. How did they hire you in the first place when there was no suitable work for you? The recruiting practices in the private sector are usually very well defined & focused. Or was there any situation of your not being able to fit into the company culture/environment [especially since you also mentioned that you were not assigned any matching work]?

I dont understand why HR head didnt want to relieve you when you dont have work to do...its like they are more interested to keep you in company for another three months and pay you for same period without any contribution....HR should analyse what the company is gaining by your presence since joining...and if your manager says that there is no growth for you means they dont require you further...so why not relieve...
does HR head some person glitches with you....usually it completely depends on reporting managers to relieve the candidate...even if they relieve candidate immediately it is also accepted by HR people..provided no violation of exit policy. in such cases many of the managers waive off the notice period....

Respected Mr. Balaji,
today's world does not goes in dreamy way. it's now became world for existence.
any verbal confirmation is not at all a proper proof to keep an employee in a dark space. So, i advice you donot deliver any notice on resigning the company from your side because you donot have any proof.
