Dear All,
I would like to know what will be the penalty raised for not filing ESI half yearly returns from April-08 to April-10 and Pf Monthly returns from Feb-06 to July-10 and Annual returns from April-05 to April-10.
Please let me know immediately as i want to give the feed back immediately.

I believe your Employer will face a problem for Inspection from the concerned Department if there is not a valid reason for non filing the Return's to the concerned Department,

are you deducting the amount from employees part of wages, if yes than its and 100% penalty because you are utilising employees money and the interest on PF amuount
ESI doesnt matter if nobody had claimed.
go the respected offieces of each, catch the commissioner, take their advice, sort out ......................... i hope you understand or else 100% penalty means 100% of rs.100.00

We have paid the challans, but only monthly, half yearly and annual returns is not submitted.
Pls. let me know penalty against not filing the returns, as payment is made 100%.

Dear Kavitha
Its nothing to worry, just approach the Authorities and submitt the Reconcilation Statement and the returns.They will charge nominal penal damages and an notice for non submitting of returns.

i advise u plz submit the return as soon as possible
coz in both case the department can go to the court against u for non submission the returns. In case of esi plz submit the return very soon. U will face a major problem on the time of inspection of epf and esic.

Please prepare a anuual returns for all the years (form 6, 3A), take hard copy printout as well as CD, meet commissioner. he will do the need full. Prepare a letter stating the reason for delay.
Where is your PF Office? it is in Bommasandra?

employers contracts a labour consultant for his firm, their charges are reosanable like between 1000 to 2000 per month, against this charges they provide you following services

provide you timely Notification of any changes in PF, ESI, PT, Minimum Wages

preparing monthly wages register and salary slips

preparing and submitting PF & 12A, ESI and PT Challans

yearle returns - PF (6A and 3A), in april

half yearly returns - ESI (Form 6) in april and october

increase of minimum wages in monthly wages register and salary slip

they also pick up declaration of pf/esi from you and submit to respective offices (done evry week or month)

communicate with officials on behalf of you.

atten client meetings with your representtives (for any clarification re from client side) etc.

u only need to appoint a consultang against an agreement with him, authorize him for communication and submission of documents and pay him his monthly charges.

Nothing happens. if you have paid all the contributions and the admh charges, just go ahead and file the returns now. Most probably it will cost you a decent lunch and a small gift to the visiting inspector.
