i am working with Facility Mgnt Co. n i want to know
that, is there any wayout by which we can get away
with Leave register maintaining? i mean can we give
employees fixed leaves for a year n encash the same
if unavailed at the end of the year??
pz consider legal aspect also.

Hi Yogendra..
Mostly there are 3 types of leaves prevailing in the organisations..
1. Privilege leaves/ Paid leaves / Earned leaves - 16
2. Casual leaves - 8
3. Sick leaves - 8
Out of these leaves casual & sick leaves can be availed only during that financial year.. whereas Privilege leaves are carried forward to the next financial year.. and these can be encashed.
Moreover as you are planning, some companies already implementing the same types of leave policy.. The name of those leaves are All Purpose leave (APL), and it is 30 or 32 in a calender year..
But out of this 30 or 32 leaves employee is bonded to avail atleast half of the leaves.. because only half of the APLs will be carried forward to the next year... remaining will be lapsed if any..
In some companies it gets encashed on yearly basis whereas in some companies it gets encashed only at the time of separation from the company...

even CLs are encasheable these days:
the reason is very simple: unscheduled leaves affect the bottomline so apart from giving an attendance allowance eg 500/- every month for people not avl leaves, companies encash the entire leaves unavailed at the end of the year.
just keep in mind that such a policy is not a garb for forced labour.

However, Leave policy should be line with overall HR Policy of the Company which determines the path, orientation and direction of such employee related policies.
There are two schools of thought on Leave Encashment. One, that employees must take leave to rejuvinate themselves. Second, to discourage them from taking leaves and announcing rewards and encashment policies. Your Company has to decide the broad view first.
In any case, you can not do away with leave register/record because it would be easy for you to answer their queries from time to time which are bound to come some time or the other.

But is it possible that we straight away tell the employee
at the time of joining that you will get ...paid leaves for a year
which if not availed can be encashed after the end of the year
and only maintain record of such leaves instead of seperately
maintaining CLs or SLs etc.
