Hi, We are an IT company based in Ludhiana and Mohali. We are giving 12 paid leaves as if now to employees and 10 public holidays.
Currently I am facing a challenge of frequent unplanned leaves and leaves with weekends. Can anyone suggest how it can be handled? What leave policy we can make to tackle the same.

Your company's leave policy should not be inferior to the one under your State's Shops and Commercial Establishments Act. Under Punjab Shops and Commercial establishments Act also there is a provision for granting of leave with wages. accordingly, it is 7 days casual leave, 7 days sick leave and earned leave at the rate of one leave for every twenty days worked in the preceding year. If you are not giving the leaves as provided under the Act, first make it as per law.
Now coming to the issue of unauthorised leaves, I would suggest that right to approve leave of any kind rests with the employer. If anyone takes leave without informing, you can mark it as absent without pay. If the employee does it again, issue a memo and warn him of serious consequences including termination from service.

How we should work out the leave for the year 20-21.Apr To March 21)
we have already lost two month for lockdown period.started office in june.how we calculate our leave balance.as we give 10 days
C/L & 11 days P/L.total 21 days in a yr.as per shops & establishment.

Pl specify the nature of activity, whether you are running a factory or commercial establishment and whether the lock down period was of no activity or it involved WFH. As a general rule it can be said that proportionate deduction in relation to the no work period is proper.

There is nothing wrong in giving PL in proportion to the days worked. Therefore, if you have not worked for two months, proportionate reduction shall be made in the PL for the year 2021. In the case of CL which is credited for the year in advance, shall be allowed/approved proportionately.
