Dear Mr. Khola,

In our company, we made a Standing Order in the year 2005. However, in 2007, we changed our company's name, and we have not yet updated the Standing Order to reflect this change. In the meantime, we have started another unit in a different location.

In this regard, my questions are: How do we update the registered Standing Order, and is it necessary to create a fresh one for our new unit, or will the existing one also apply to the new unit?

Your valuable guidance is needed in this matter.

Dear Ram,

As per Section 10 of the Industrial Employment (Standing Orders) Act, 1946, we are required to apply for the modification of the certified standing orders. In my opinion, we need to reapply for certification of standing orders for your new unit. We can follow the same procedures as those in place for your first unit. If the representatives of this new unit do not have any objections, the Certifying Officer will certify these standing orders on the same lines.

Thank you for your valuable reply, Shri. Khola. For your information, in both the old and new units, all employees come under the same company. We have no unions in either of the two units. Both units are referred to by one name, and salaries are also paid from the same company's account.

Dear Ram,

If the unit name at both places is the same, then in that case, modification is required to add the name of the unit with a different address. If no union is present, the representative of the workmen will present their opinions/comments before the Certifying Officer of the area for any alteration/modification in the existing certified standing orders.
