Understanding Model Standing Orders
Model standing orders are meant for an organization where there are no Certified Standing Orders (CSOs) for that establishment. Initially, before being certified, you will have to prepare a draft Standing Order in consultation with the Union. If there is no union, then five representatives of the workmen should be involved.
The proposed CSO should align with the Model Standing Orders, and no deviation from any rules or regulations stipulated is entertained. A copy of the proposed CSO in quadruplicate should be submitted to the certifying authority, i.e., Assistant Labour Commissioner (ALC) or Deputy Labour Commissioner (DY. Labour Commissioner), who is the appropriate Government authority for the State or Central Government, with a covering letter from both parties, i.e., Management and Union.
The certifying officer will then schedule a hearing date, and if there is no dispute, will certify the Standing Orders for the establishment under his signature and seal. Therefore, after certification, the Model Standing Orders (MSO) cease to exist and will be replaced by the CSO.
