(Fact Checked)-The new ESIC rule is valid, even without a gazette notification. The increase in the wage threshold to Rs 21,000 is applicable based on the Notification Dt. 06.10.2016. (1 Acknowledge point)

  • Attention RAVI782,

No! Notification of applicability was not issued last year and is not expected before December 2016. If the notification is issued in November 2016, it may take effect from December 2016. However, if it is not issued until December 2016, it might have an effect starting from April 2017. (Please refer to my earlier thread dated 10 October for more information).

ESIC Approves the Enhancement of Wage Ceiling from Present Rs. 15,000 per Month to Rs. 21,000

The Employees State Insurance Corporation (ESIC) has approved the enhancement of the wage ceiling from the present Rs. 15,000 per month to Rs. 21,000. The draft Rules calling for objections have been published in the Gazette of India on 06.10.2016. This enhancement of the wage ceiling shall bring more employees under ESIC coverage. In addition, the decision has also been taken to ensure coverage of the Scheme in all districts of the country.

The ESIC in its meeting dated 07/08/2015 has decided to bear the expenses on super specialty treatment over and above the expenditure of the state government.

The ESIC in its 166th Corporation meeting held on 07.08.2015 has decided to consider the eligibility of pre-existing diseases, i.e., for malignancy & dialysis as prospective w.e.f. 30.08.2016.

Further, ESIC has revised eligibility for Super Specialty including the children of Insured Persons with congenital diseases & genetic disorders.

This information was given by Shri Bandaru Dattatreya, the Minister of State (IC) for Labour and Employment, in reply to a question in Lok Sabha today.

    Dear All,

I read the quoted press release which mentioned that an increased wage limit was approved by ESIC. However, the press release did not mention anywhere the date from which this new limit would be implemented. To my knowledge, no notification has been issued by ESIC in this regard yet. Therefore, in this situation, it should be concluded that the limit has been approved by the ESIC board, but as of now, the implementation date for this wage limit has not been decided.

    Corrections are welcome if needed.

(Fact Check Failed/Partial)-The user's reply is incorrect. The ESIC limit was raised to Rs 21,000 from Rs 15,000 as per the notification dated 06.10.2016, not with a new notification. Please refer to the ESIC official notification for confirmation.

  • In my opinion, the notification has still not been issued, and now it would be possible to be effective from April 2017. This is because the required 92 days may not be completed from January to March 2017, even if someone works for the full month in all three months. New entrants from January 2017 would not be entitled to sickness benefits in the forthcoming benefit period starting from July 1, 2017, following the contribution period from October 2016 to March 2017.
