I hope he is a monthly rated regular worker and Sunday is his weekly off day. If he reports to work on Monday, he will be eligible for Sunday wages. On the other hand, if he remains absent on Monday also, he will lose his off day wages.

Madhu T K is right, if he report on Monday at work place then he will be eligible for Sunday wages also or else if he remains absent on Monday then he will be treated as absent on Sunday also and he will lose his off day wage also.

Whatever be the nature of leave, if an employee resumes duty on the date following his off day/ holiday, he should be given that off day/ holiday. As already stated, in case he remains on leave on the day following the day of off/ holiday only the matter of CL, PL or LOP will have to be checked. Under normal policies, off day/ holiday intervening two CL days will not be counted as leave but that intervening two PL or LOP will be counted as PL or LOP, as the case may be.

Dear Senior,

The advertisement company is eligible for ESIC coverage. If yes, please send a notification. Additionally, considering that ESIC coverage now applies to businesses with 10 or more employees as per Section 1(5) w.e.f. 01 April 2011, I am uncertain about whether all ten employees should have salaries below Rs. 15,000 or if having at least one employee below this threshold is sufficient for ESIC coverage. Clarification on this matter would be appreciated.

Dear Senior,

ABC organization had applied for approval for EPF exemption under section 17(1)(a). They complied with EPS and submitted it directly to the EPFO office. Unfortunately, they did not receive approval from the EPFO organization. Meanwhile, some staff resigned from ABC organization and joined XYZ organization. ABC organization paid a cheque by hand to XYZ Organization for the amount of EPF contribution for the departing staff, along with EPS contribution details and Annexure K. Similarly, XYZ organization submitted that cheque to XYZ EPF Account along with EPS details. The individual EPFO organization confirmed that the cheque had been credited to XYZ EPF Account on the same date. However, ABC organization has since dissolved, and the EPF contribution has not been transferred to XYZ organization's account. Currently, 90% of the staff have claimed their EPF benefits from XYZ organization but have not received the EPF contributions from ABC organization. The EPFO Department states that ABC organization is not an exempt organization and is requesting Form 3A and 6A, even though ABC organization timely submitted Form No. 7 EPS and 8 EPS. What is the procedure to obtain the EPF contribution from ABC organization?
