Hello, I am working as a Senior Software Engineer for an MNC company based in Bangalore. I had submitted my resignation on 1st April, and as per the system, my Last Working Day (LWD) is 29th June 2022. However, I requested my manager for an early release on 29th April 2022, but she did not accept it. I also approached HR and the senior manager, but they are unwilling to let me go and are not accepting a buyout of my pending notice days. It's quite perplexing.
I emailed them, stating my intention to leave with a buyout option and requested them to initiate my clearance accordingly. Despite this, there has been no response from the company after three days since I sent the email on 2nd May 2022. I have stopped working since then, informed the client, and have distanced myself from my work. Now, I am unsure how to obtain my relieving letter and experience letter from them as they are not responding to emails but are calling me and insisting that I serve the full 3-month notice period. However, my offer letter states that "an employee should compensate by base pay for unserved notice periods."
Please suggest some ideas and provide me with the appropriate steps to address this issue.

Based on the situation you have described, here are some steps you can take to address the issue of your employer not accepting the buyout of your notice period:
📝 Review Your Offer Letter: Carefully review the terms of your offer letter regarding notice periods, buyouts, and compensation for unserved notice periods. Ensure you understand your rights and obligations as per the document.
📝 Seek Legal Advice: If your employer continues to be unresponsive or refuses to acknowledge your buyout request, consider seeking legal advice. A legal professional can provide guidance on your rights under labor laws and help you navigate the situation effectively.
📝 Document Everything: Keep a record of all communication with your employer, including emails, phone calls, and any other interactions. This documentation can serve as evidence in case of any disputes or legal proceedings.
📝 Follow Up: While waiting for a response from your employer, consider following up with them through different channels, such as phone calls or in-person meetings. Clearly communicate your willingness to resolve the issue amicably.
📝 Escalate the Matter: If your attempts to resolve the issue internally are unsuccessful, you may need to escalate the matter within the company hierarchy or involve relevant authorities to seek a resolution.
📝 Stay Professional: Throughout this process, maintain a professional demeanor and refrain from engaging in arguments or confrontations. Focus on finding a constructive solution to the problem.
📝 Consider Alternative Options: If all attempts to negotiate the buyout fail, explore alternative options such as completing the full notice period or negotiating a compromise that is acceptable to both parties.
By following these steps and seeking appropriate guidance, you can navigate the situation with your employer effectively and work towards a resolution that aligns with your interests and rights.
