Dear Seniors/Professionals,

I am employed with a reputed organization in NCR as Dy. Mgr. for the past 10+ years, being recognized as one of the best performers.

One day, an HR person called and asked me to resign due to an annual lower performance rating. He explained that there was top management pressure to remove employees with lower ratings (approximately 10-15 persons) for manpower cost-cutting purposes.

The HR representative explained that my performance was deemed acceptable, but there were some alignment issues with the plant head that were never previously communicated, and there were no prior warnings or negative records. My rating in the HR system's performance index was 4.5/5.0, but the final manual rating was 1.0/5.0.

Ultimately, I had to resign, and HR assured me of compensation with 17 days of gratuity and 2 months' salary. The company has already let go of around 12 individuals in a similar manner over the last 3 months, providing verbal assurances of support for finding a job with a supplier. Sources indicate that they plan to terminate 60 more employees in the next 2-3 months and replace them with freshers.

We believe the company should have offered a Voluntary Retirement Scheme (VRS) with (90+17) 107 days of compensation multiplied by the number of working years, as some other MNCs have done in the past.

I seek guidance and support from seniors/professionals on what steps can be taken, either individually or as a team.

Thanks/Regards;

Dear Rahul,

Good Evening,

I need some clarifications about the issue that you have stated:

1. Do you want to continue with the same company as an employee?
2. Do you just want to receive your compensation as per your expectations and resign?

For either of the cases, we will need the following proof:
1. The service period that you were with the organization.
2. Email proofs from your HR stating your reason for resignation.
3. The compensation that the company was willing to offer as a written statement.

If you can forward these details to my email address karthickhr.sss@gmail.com, we, under the Ministry of Human Resources, can take necessary action to ensure that you receive justice.

Thank you.

Sir,

As mentioned, an HR person called and asked me to resign as my annual performance rating is 1/5. They will pay 2 months' salary as per the notice period and a gratuity of 17 days. There is no communication in writing, and I have to resign. I do not want to work with the company now. HR is under pressure to cut down labor costs, so they have done the same with 12 to 15 staff persons from engineer to manager level and will continue for the next 2 or 3 months. I have a total of 20 years of experience, with 11 years in this company. Usually, when MNCs came 10 years back, they used to provide VRS with compensation of 107 days' salary per year of working experience. People are resigning under pressure and do not have jobs in the market. How can we pressure the company for VRS or better compensation as individuals or as a team of staff members? What are the options? Please support.

Thanks and regards,
Rahul
