Dear All,
Sunday is the weekly holiday in my company. My question is, if any employee takes leave on Saturday and Monday, should the company pay them for Sunday?
Another question is, if an employee takes leave for a month and there are 3 paid holidays (festivals) in the respective month, would the employee be eligible for payment for those 3 days? However, there are no CL (Casual Leave) and PL (Paid Leave) in my company.
Kindly reply.
Regards,
Urgy

Hi,
It depends on the company's HR policy, which varies from company to company. Most organizations don't pay if you take leave on Saturday and Monday, and if Sunday is a holiday, the same applies to festival leaves. According to the law, you shall be paid; however, there are many loopholes.

Dear Urgy,
Under which act are you required to give paid weekly off days and festival holidays? Are you not covered under any law relating to the grant of Casual Leave and Privilege Leave?

Dear Urgy,
By only stating that you are running a proprietorship company, I am unable to determine under which labor law you are required to provide a weekly off, with or without wages. We will be able to ascertain the rule once we examine and finalize which Act is applicable to the Company.

Intervening Festival Holidays or Weekly-Off NORMALLY should be taken into account while granting leave for an employee. If the employee goes on unauthorized absence, then the intervening HOLIDAYS will also be treated as unauthorized absence.

Dear Sir/Madam,
Does this mean it will be treated as Leave or Holiday? Please reply.

It is most immaterial and irrelevant how the firm/company has been formed, whether as a Proprietorship, Pvt. Ltd, or a Limited Co., insofar as leave rules are concerned. What matters is under which law you are registered – the Factories Act or the Shops Act. Once you unravel this "secret," then you can read the relevant portions/sections of the applicable law and get a clear picture of the leave rules that would apply to your company/firm.
However, I am shocked when you state that your company does not have a system of SL/CL, and PL. This is against the law.

Dear Sir,
Thank you for your reply.
My company is registered under the Shop Act. Could you please share the rules regarding paid holidays as we are discussing this in relation to the Shop Act?
It is quite shocking to discover that my company does not have Casual Leave (CL) or Paid Leave (PL). Despite being registered under the Shop Act and providing Security Services, with licenses such as PSARA (Private Security Agency Regulation Act-2005), Guard Board Exemption, and other certificates including PF, ESIC, and PT, ST, the company, which has approximately 250 employees, does not offer any form of leave as mentioned above.
