Dear All,

I have checked in the PF records and found that one of our employees is already enrolled in another establishment. I have asked him how it is possible for a person to enroll with the same UAN in two establishments. Kindly suggest to me what needs to be done and discuss with management for prompt action.

Hi, UAN once allotted will remain the same till retirement. While the UAN number remains the same, only the PF number will change from company to company.

If you are referring to another active PF number, then it might be due to the following reasons:

Employee might have joined your organization before properly getting relieved from the past employer.

Or

Employee might be working for another company now concurrently.

Hi,

He is working at Company B but is still having his PF contributions processed through Company A.

Company A's Date of Joining: 02-Feb-2022
Company B's Date of Joining: 01-Aug-2021

I believe he is still employed by Company A, even though he has been reluctant to acknowledge this.

Please advise on the necessary steps to address this situation.

Hi,

If PF contributions are reflecting from 02-Feb-2022, then he still works there. This amounts to dual employment. Call the employee and ask for an explanation.

With regard to action, it is your (Employer's) decision. Either issue a warning letter not to do so, or terminate his services after serving a show cause notice and receiving an explanation letter from him.

Double employment is a penal offence as per the Factories Act 1948. Action is liable against the employer for violating the Act. Now that it has come to light, action has to be taken, and the only punishment is the termination of service after disciplinary action, particularly since the employee is in denial.
