When should an employer release the salary slip to his/her employee? Can the salary slip be provided at the time of the salary release, and if so, what will happen if the salary disbursement is delayed due to some reason? Moreover, what does the law state regarding the obligation of employers to issue the salary slip?

Dear Member,
In general, wage slips are required to be issued to the employees under the Minimum Wages Act, 1948, and the procedure and the format are provided by the applicable rules. Similarly, where the Contract Labour (R&A) Act, 1970 is applicable, wage slips are required to be issued to the workers as per the applicable rules. In general, wage slips are required to be issued a day prior to the disbursement of wages. To be more specific, you may go through your applicable Act and rules.

Salary Slip - When one makes payment to another, the details of the payment should be specified. If not specified, the choice of allocating the payments to any heading rests with the receiver. This falls under the Indian Contract Act. Similarly, if the employer provides payment details in the salary slip and the employee accepts it, it is binding on both parties. If not, then items such as salary advances, incorrect or overpayments, or any other adjustments will be decided by the employee. The employer cannot then claim not to accept it. The employer had the first opportunity, which the employer did not take advantage of, at his peril.
