Hello all,
Company is going to close India operations and told after 3 months it will last working date, And employee got opportunity of offer if willing to join early with other company, but current employer is not willing to let go of him and asking him to serve notice periods of those 3 months and because of that employee lost that opportunity.
Because of that depression he didn’t work for 4 days and now company is saying they will terminate him,because he didn’t work 4 days.
And they didn’t give him any signal warning also
Please suggest what employee can do in this situation.

In the circumstances explained, if you have documents to prove your averments, especially with regard to their advance notice of closure and consequent retrenchment being facts that could be substantiated, you should try to issue a legal notice for early relief to enable you to seek alternate employment elsewhere, highlighting the closure. Perhaps you should be prepared to compensate by cash equivalent.
Regarding your 4 days' absence, does it cover the lockdown period? If it is outside the 'lockdown' period, then you will have to manage either to convert it to leave with pay or without pay. Absenteeism during the 'notice period' is not normally permitted. You have to find ways to justify.
