Hi there, I am facing a problem. I used to work for a company that operates in the networking sector. I was appointed as a Warehouse In-charge there. However, my department was changed one month before I left the job. Despite this, my full and final settlement is still pending. I have sent them many emails, but even after 8 months of leaving the job, they only recently responded and mentioned that there is a pending material RECO at my end. Another person has been appointed in my place. Since then, I have not received any further communication from them, nor do I have any documents regarding the change in my department. Now, they are threatening to take legal action against me. What should I do now?

a) When you were separated from the organization, was it a normal separation, or did you abandon your duties?
b) What are the terms of separation mentioned in your appointment letter? Did you complete the notice period as stated in the appointment letter?
c) Before you left your organization, did you officially hand over the charge of your duties? If yes, do you have any photocopies of the documents with you?
d) When your department was changed, did you officially hand over the charge of your duties? If yes, do you have any photocopies of the documents with you?
e) To which department were you transferred? Why were you transferred? Did the management want you to resign but instead of directly informing you, they changed your department and created conditions for your exit?
f) When you mention that your Full and Final (FnF) settlement is pending with the organization, what are the components of FnF? Did you receive last month's salary?
g) As the Warehouse In-charge, how many persons reported to you?

If your employment terms do not have any loopholes, you can send them a legal notice regarding the full and final settlement. Inquire about any pending materials from your end that are owed by the company. You may send this inquiry through email as well as registered post.
