Dear Mr. Jegadesh,

The TN Government has not notified any special holiday for the Panchayat Election 2019. In light of the Madras High Court judgment, there is no need to declare a holiday with wages for the Panchayat Election.

Please show them the attachments and ask them to explain on what basis they are requesting the declaration of a holiday for the Panchayat election 2019. The holiday declared under the Negotiable Instrument Act is also not applicable as per the Supreme Court ruling (attached). The Tamil Nadu Government should have declared a Special Holiday under the TN IE (N & FH) Amendment Act, similar to what was done for Pongal (attached; not specifically mentioned as a paid holiday).

Even at the time of declaration of Special Holiday for Pongal in 2018, the TN Govt did not choose to declare a holiday with wages. In the absence of a clear notification from the government, you do not need to declare a paid holiday for the TN Panchayat Election 2019.

In his letter (Not GO), the Addl. Chief Secretary has only requested for a holiday. JDISH again has requested for a holiday, quoting the Panchayat Act. According to the Madras High Court in TN Petro Products case (attached), the leave and holidays for employees working in a private industry are governed by the provisions of the Tamil Nadu Industrial Establishments (National and Festival Holidays) Act, 1958. Therefore, there is no need to declare a holiday with wages for the Panchayat Election in TN for 2019.

In case a filing is made by any person, it is worth paying a fine of Rs 500/= as per sub-section 3 of Section 80A of the Tamil Nadu Panchayat Act, 1994. Please check the provisions of the Act thoroughly as I am not able to find the same.
