We have one employee who has completed 21 days out of 90 days of notice. How much will he get for his gratuity, leave encashment, and how much will he receive for his salary?

His details are as follows:
- Basic: 7131
- Annual leave balance: 74
- Date of joining: 1st May 2009
- Date of leaving: 16th April 2019.

Hi,

Gratuity depends on his final date of relieving. The last drawn basic salary multiplied by 15/26 multiplied by the number of years completed.

The notice period is the employer's internal policy, and any shortfall in the notice period can be recovered from his Full and Final Settlement provided that you have that clause in the appointment order (either 3 months' notice or salary in lieu of notice).

Leave encashment is based on the number of leaves in credit as of the date of his relieving.

Dear Friend, Leave encashment calculates on Gross, and salary calculation as you do on Gross/31*21 and deduct his statutory.

The employee has to complete the notice period; if not, the shortfall days will be deducted from the remaining leave balance in his account.

In this case, if not completing 68 days, they will be deducted from his remaining leave balance, i.e., (74-68).

Leave encashment for 6 days = Rs. 1426.
Salary for 16 days on a gross basis.
Gratuity: 9 years 11 months 15 days @ Rs. 7131 is Rs. 35655.

Dear Concern,

What if he doesn't have enough leave, i.e., here he has 74 leaves, but what if he has only 30 leaves? Then from where should we deduct the amount, can it be deducted from gratuity?
