Dear Sir,

I am in a position where I am unable to resign. There is a delay of around 3-4 months in salary payments in my organization, and I also have pending dues for my travel and daily allowance. I have received a good job offer. What should I do now? Please advise.

Thank you.

Disbursement of salary on time to the employees is a contractual obligation imposed by the terms of the employment contract on the part of an employer. When the employer fails to fulfill this obligation continuously, he cannot harp on the failure of the employee to comply with the notice conditions before unilaterally terminating the contract from his side. Therefore, the employee can resign from his job immediately based on this valid ground alone and pursue an available better offer.

Hi,

Given the circumstances of your company, it would be wise for you to quit your present job, join the new one, and pursue the dues owed to you. You can achieve this by sending a formal letter outlining the facts and requesting prompt settlement of the dues. It is essential to maintain a courteous and diplomatic tone in your communication to ensure a full and final settlement. There is no benefit in remaining in an organization that does not prioritize the well-being of its employees.

Thanks and Regards
