If an employee dies during the course of employment, what benefits will his/her dependents receive under ESI and PF? Additionally, will the family be entitled to monthly dependent benefits under ESI and pension under EPS? I kindly request further clarification on this matter.

In the course of employment, was the employee on duty and working at the time of death? If yes, then the employer has to report the same immediately to ESIC via Form 12 to the labor inspector and chief inspector of factories.

There is no concept of dependent benefit under ESIC. If formalities are done properly and the first aid/treatment goes through the ESIC channel, then the employee is eligible for medical treatment and funeral expenses.

Under EPFO, there are several benefits available to the nominee. Ask the HR personnel if KYC compliance has been completed; they would then assist in proceeding further.

Dear sir,

Further to your reply regarding the thread on the death benefit for dependents of the insured person, as per Section 52 with the provision of 6(a) of Section 2, dependents are eligible for dependent benefits.

There are plenty of acts and regulations for the benefit claim of the employees; state-wise, it differs. Even without ESIC and EPF, there are certain welfare benefits from the state government, but everything depends on documentary compliance. In practice, the ground reality display is 180 degrees opposite.

If an employee dies during duty hours, what procedures should the employer follow to report to the concerned departments? Immediate filing of ESIC Form 12 is mandatory to establish that the death place and date/time were the duty place. If this is done properly, then the nominee/family members can be in a position to file a claim.
