I have been asked to resign from my job as a Business Analyst. My full and final settlement is pending with HR. The company is asking for people's resignations as it is running at a loss and can't pay salaries. I have also not received my salary for 3 months to date, but my problem is bigger.

My PF deduction for the first 6 months with the company was done at 12% of my basic salary with the same amount of contribution from the company. However, for the last 6 months, the PF contribution is only Rs. 1800 from both my side and the company. My appointment letter does not state anything about PF contribution.

My question is can the company change the PF contribution without informing the employee or PF authority?

PF contribution depends upon the salary structure of the employee, subject to amendments of the EPF Law/Rules from time to time. You have to check the relevant rules applicable as of the date from which the PF contribution has been reduced.

Regarding performance bonus, if performance has been duly certified and proof is available, you may serve the company with a legal notice, but only after one or two written representations to get a response to your representations.

How much contribution has been deducted from you every month? Tally that with your passbook. It may be that the company has not paid their challans for a few months and will pay them in a short time, as you have already stated that the company is experiencing a financial crisis.

Sir’s My question remain unanswered...THAT CAN COMPANY CHANGE CONTRIBUTION OF EMPLOYEE AND EMPLOYER TO EPF WITHOUT INTIMATING EMPLOYEE AND PF AUTHORITY...PLZ CLARIFY
