Can we re-join any workman after completing 58 years, if he is already receiving PF pension? If it is possible, can we show his wage breakup (Basic + DA) with a minimum wage less than 15001, without PF deduction.

Please tell me the rules as per EPF and labor laws.

If someone has retired and settled his/her EPF & EPS, then he/she is an excluded employee as per EPFO. He can be engaged without PF contribution. But if the monthly gross salary is below INR 21,000 per month, he is eligible for ESI.

If the salary is above 15000/- and he/she has already settled their existing EPF, then they shall be treated as an excluded employee. If the wage is below 15000/-, then the contribution towards EPF is mandatory.

Please note that if he/she already has EPS and is receiving a pension, EPF contribution shall be mandatory.
