IT and ITES establishments come under the purview of State Shops and Establishments Acts. For instance, the Government of Tamil Nadu has notified shops and establishments employing 20 and more no. of employees as "establishments" covered by the Payment of Wages Act,1936.
Therefore, the poster may verify the fact whether such a notification u/s 1(5) of the PW Act,1936 has been issued by the respective State Govt.
