I want expert advice on the folloing querry:

X Employee is getting Salary as under for example:

Basic 37625

Allownces

Petrol 9622

Car Allow 7500

Car Maince 1500

Medical 3760

Spl. Allow 5000

PF Cont. 4515

Gratuity 1567

LTA 3135

Misc 1000

In total CTC works out ot be Rs.9.02 Lacs on the above basis and the Company wants to give HRA as well as Bonus to the extent of 40% of the basic and bonus to extent of 2000.00 PM fixed.

The Company says that Special Allowance will be withdrawn and Car petrol will be considered to the extent of actual usage which tot he extent of Rs.6000 to Rs.7000 PM for calculating the new CTC. My question is how they can withdraw the special allowance being given to the employee over the years and petrol expenses on actual usage basis instead of the entitilement of the employee. Under this arrangement the increase will be to the extent of Rs.1.04 Lacs against the promised increase of Rs.2 Lacs because of non consideration of actual entitlement and withdrawal of special allowance.

Company has the right to withdraw any benefits and special allowances given to its employees. They cannot reduce your Basic Salary or DA. But other allowances can be curtailed, withdrawn, reduced or enhanced at the discretion of Management and the financial conditions of the company

I have received a letter from Chief Labour Commissioner New Delhi addressed to Adl. Labour commissioners for payment of wages through bank accounts to employees.

In light of my above attachment, please let me know whether the Central Chief Labour Commissioner is authorized to direct for making payments through cheque/bank account in the near future or if an amendment is required in the Payment of Wages Act 1936.
