I have a question. I currently work for a company and have spent around 4.6 years, but there is no mention of Gratuity in my Appointment letter. Do I still qualify for Gratuity after completing 5 years, and what is the minimum tenure to qualify for gratuity?

There is no need to mention gratuity in the appointment order. If you fulfill the conditions for the payment of gratuity, and the industry you work in is covered under the Payment of Gratuity Act, then the company is legally bound to pay. Five years of continuous service is the minimum required to become entitled to gratuity.

Gratuity Act applies to all businesses in India that have 10 or more employees. So, retail is definitely covered.

It applies to all employees, not just workers. So, everyone from a peon to the managing director will be eligible for gratuity once the other factors listed by Anish are fulfilled.

An employee will be covered under the Act if the organization employs at least 10 persons on a single day in the preceding 12 months. Once an organization comes under the purview of the Gratuity Act, it will always remain covered even if the number of employees falls below 10.

I would like to differ a bit on this. Even though you have not completed 5 years, if you have completed 6 months in the last one year, then you are still eligible for Gratuity. Please refer to Section 2 of the Gratuity Act for further explanation.
