Hi Everybody,

I need your valuable advice. Can an apprenticeship be covered under the Workmen/Employee Compensation Policy if taken for their benefit? As per my understanding, neither are they workmen nor employees. Please clarify.

Yes, sir, surely... without any hesitation, at any point in time...

All employees of regular type, temporarily based, apprentice type, on contract belong to a contractor, daily labor workers like helpers engaged on daily wage through a maistry or a contractor. All the above are undoubtedly eligible for the Workers' Compensation Act, previously known as the Employees' Compensation Act.

Go ahead and help the poor... Finally, I conclude that a daily worker who joined an hour ago is also eligible when injured or unfortunately dies due to an accident by fluke.

Dear Sir, is an interns/ apprentices covered under WC policy ? if he got injury/ death during deputation in any factory/firm for company purpose? is WC policy applicable on interns/apprentices?

Dear Colleague,

As per Section 16 of The Apprenticeship Act 1961, it states that the Employer's liability for compensation for injury. If personal injury is caused to an apprentice by an accident arising out of and in the course of his training as an apprentice, his employer shall be liable to pay compensation, which shall be determined and paid, so far as may be, in accordance with the provisions of the Employees' Compensation Act, 1923, subject to the modifications specified in the Schedule.

Hence, in the case of apprentices, the employer is liable to pay compensation in case of any injury by accident arising out of and in the course of his training as an apprentice. Therefore, you can very well cover the apprentices under the WC Policy as the risk is covered.

Interns definitely will be covered in the policy Apprentices, I don’t know It is better to get a written clarification from the insurance company before you take the policy
