My query is about withdrawing my PF amount from the last company I worked for. I was there for about 3 years and 7 months. Although I did not officially resign from the company, I had to leave due to illness. It has been 3 months since I left, and my previous employer is now asking me to pay them 2 months' salary for not serving the notice period.
Please advise me on how to claim the PF amount in this situation without involving my previous employer. I am currently unemployed and in urgent need of funds to start a business.

You can ask your company for your PF UAN number. If you join another company, they can directly claim for PF transfer. If you want to withdraw PF, you have to obtain the PF form from the PF office, and your current company will need to sign and stamp it. After that, you can submit it to the PF office. Any company cannot stop your PF amount withdrawal.

Whether you have absconded or resigned, the company cannot withhold your PF amount. As per law, the PF amount cannot be attached by any court of law. Therefore, if your PF is unexempted, i.e., if it is maintained at any RPFC, fill in Form No. 19 and Form No. 10-C. Get your signature attested by the Bank Manager where you hold an account and send the form directly to RPFC with a covering letter. Your PF has to be settled by them. The company cannot withhold it under any pretext.
