Send a resignation letter by post with acknowledgment due and copy to your HOD's HOD. Do not worry about the threat of him saying you are a fraud, etc. If he states falsehoods or defamatory statements, the law of the land will be against him. Please ensure that the employee followed this procedure. If the employee provided a resignation intimation via email to all concerned persons, then he must have a copy of the same in the sent items. If this has not been done yet, then please send the email and specify the actual date of resignation. If only a written letter has been given, then obtain an acknowledgment on another copy of the same.
You can also ask in an email on what basis anyone is threatening you with fraud charges, and CC the concerned person's Reporting Manager as well.
