My previous company told me to resign and relieved me on the same day. They have not cleared my full and final settlement still for more than 9 months. There were 64 balance leaves. They are hesitating to pay one month's basic salary of the notice period and the amount of 64 leaves. I am in another state far away. I am following up on the telephone as well as on emails. But there is no response. My dues are more than 1.25 lakhs.

What should be my next course of action? How can I proceed? Is it mandatory by law that the company has to pay me the dues of 64 leaves as well as one month's basic salary? In my appointment letter, the clause for one month's basic salary is mentioned. Please guide me.

Since you worked in Surat, you are governed by the Bombay Shops and Establishment Act. Make a complaint to the inspector under the Act for non-payment of dues. Enclose all correspondences made by you with the employer.
