This is Prashant from Mumbai. I've been a member of this firm for almost a year and this has been a great platform for learning about HR.

However right now i have some serious concerns for which i would need your help.

I along with few colleagues have been associated with an organization name UIPL (I'm using the codes) in Mumbai. One fine day our organization decided to terminate our services. They asked us to resign without giving us a notice period. Now it has been more than 3 months and they haven't cleared our pending salary (i.e. full & final settlement). As per our appointmet letter it has been clearly mentioned that "During the period of probation, your services can be terminated by either party by giving to the other, a notice of 1 month in writing. After confirmation, your services can be terminated by either party by giving to the other, a notice of 3 months in writing. The company however reserves its right to terminate your employment by giving to you salary and benefits for the number of days in lieu of the notice”.
We all a had a confirmed status in our organization. The company has failed to provide us with our final settlements at a number of instances. We have written them a mail and they had agreed to pay at a number of instances and the directors mentioned that they would give us the salary on these specific dates (7th Sep 2008, then it became 20th Sep 2008, then it went to 30th Sep 2008, then 10th Oct 2008, then 24th Oct 2008). And now the company says they cannot pay us as they don’t have funds. The Directors of Unicorn also hold a firm with the name of 4dimtech. They have the money to hire for that firm but they don’t have money to pay us. Since the time we left it has been almost three payroll with 4dimtech. It has been more than 2 months and we are still awaiting our payments. There is no one to answer our calls. The Directors are taking us for granted, and if we tell them about the laws in India (Payments of Wages Act. & ID Act.) that govern our rights as an employee then they say that the Laws in India would be of no good help. In the past one year the company has always delayed the payments, till the time we were associated with the company.
At this occation I would request you all to please take the initiative to help us with this issue. We have written a mail to 'laborweb@nic.in'", however it was not of any help.

If anyone is aware of any labour personnel then please pass on the contact.

Any help on this issue is appreciated. You may revert back on this email id, in case of a query.

You Have To Help Yourself, You Won't Get Your Dues Until You Intimidate Your Employer. You Must Approach To The Commissioner Of Labour Office For Registering Your Case Jointly.......
Simulteneously Threated Employer To Lodge A Individual Police Complaints Against him For Cheating And Misappropriation Of Your Money.....

I Have Very Good Understanding Of Employers Of Small Properiotory/ Partnership/ SSI/Medium Scale Business Owners and Businessmans Psychology..
This is due to now a days Trade Union movement has been dead and Employers are scotfree to do anything in liberalised economic enviornment where Money is power they can buy justice but you can harrash them which these businessmans are afraid of........... Because they know time is money they don't want to invest in fighting for small reason....

Thanks for your suggestion. We have told our employer that we'll be approaching the police and would be taking legal action against him, however it seems that it doesnt bother them much.
It would be great if you may let us know about some Commissioner of Labour office as I'm not aware of any and also the place where they are based. We appreciate your quick response. Please do revert because we would want such employers to be punished for ill-treating their employees as well as ill treating the law of the country where they do business.

I Think Telephone Directory Yello Pages For Your City Will Find Commissioner Of Labour Address. Most Of Directorate, Commissionarate, Collectorates Are Mentioned With Contact Telephone Number.
This Is Best And Easy Way Because You Need Not To Waste Time.......
You May Also Ask Any Trade Union Office Bearer They All Knows Address Of Labour Commissioner.
You Have Not Mentioned Your City So Its Difficult Even If I Knows Only Few Cities Where I Had Been Worked.
Your Employer May Have Shattered From Inside But He Will Wait And Watch Your Action And Finally When He Is Sure That This Is Not Just Intimidation But Real Threat To His Privacy He Will Surrender Because Extracting Money From Businessman Is Slightly Tedious Job. You Have To Adopt Pressure Tactice And Let Him Assure He Is In Trouble.

respected sir,
i have worked for 4th dimension infosolution infosolution pvt ltd. as a back office executive for four months. They have shut down their process before two months. they give me a cheque for last month salary. but the cheque was not cleared. I have contact them so many times but they not give me any single answer. They told me "APKO JO KARNA HAI KAR LO." So please help me how to get my salary. Any Senior police officer please take action on this fraud company or avoid our children to lost their time or life....

4th dimension infosolution ye ek fraud company hai. Employees ki salary bhi yeh log nahi dete. Mr. Lopesh employees ko jo karna hai woh karlo aisa batate hai. so please avoid this company.....

Its not a single company like this..So many companies are doing so.... I think we should make a blog or site such companies,and reflect the name of such companies....so that other people cannot be trapped by such thing......

Hi Sandip,
Please note in case any cheque bounces , then you will have to approach the concerned party, but if he does not bother like in your case then you should approach the consumer court. Duly note that bouncing of Cheque is considered to be a big offense today, and strict action will be taken against the concerned person.
