Hi,

Here is my friend's situation. She worked in small company for 19 months Starting from Feb 2012. She then became pregnant and went out of India for 6 months along with her husband. She came back and then was at home due to maternity leave for 12 months. So total 18 months gap.
She again joined same company one week back. Since its small company, her employer is ready to give her experience certificate showing joining date of July 2012 and relieving date of Jan 2015. She got selected in BIG Indian MNC. Her salary is increased from 5K to 35K/month.She is planning to show just 10 months maternity leave. The company where she is selected is MNC whcih do very strict background checks.

My question: If current employer is ready to give experience certificate though maternity leave is of 18 months and if they will give details to background check agencies, is there anything of which my friend should be worried?
She has her own house and staying there since december 2014. Will company ask to furnish her addresses before December?

Company will know that she was out of country for 6 months from her passport but she can tell that it was due to maternity leave. Current employer is ready to say that maternity leave was only of 10 months. My friend told during interview that she gets salary in Cash, so no financial record present. Anything to worry about fake experience (considering extended maternity leave) but done with help of employer?

Date when she went on maternity leave: July 2013
Return to job: Dec 2014
Selected in MNC: Jan 2015
Joining MNC: Feb 2015
Getting experience letter with Joining date as Feb'12 and relieving date as Jan '15.
Does she need to worry about 18 months maternity leave? Can she just tell that she was on maternity leave for 10 months and tell that she came back to job in May'2014?

What I assume that she was not in the company for 18 months. According to maternity benefit act 1961,women employee eligible for maternity leave for 12 weeks for that she has to work for 80 days in the 12 months immediately preceding the date of delivery. Additionally, In case of miscarriage, 6 weeks leave with pay at the same rate as applicable to maternity benefit. What I also under stand that No employer will give Additional Maternity benefits with leave for more than above said period. Who would accept irrelevant logic in your friends case ?? Sooner or later, the truth will be out..

In above case, is it advisable to let company know that she was on maternity leave of 10 months? Will company (MNC) takes objection if maternity leave is of 10 months?
