Our organisation is engaged in construction activity. Most of our work is out sourced to sub-contractor having employee less than 20. Do we need them to cover under PF as they work under the premises of our client?

If the contract workers are working in a factory that is registered with the PF department, the contractor workers are also required to be covered under PF. It is then irrespective of the fact that they individually have less than 20 employees.

Hi,
As per my experience generally sub-contractor's wont be agree for it, but if sub - contractor want to registered they can even if they have less than 20 employee/ labour.
2) As you are involved in construction industry than you must ask for WC Policy and must keep it compulsory for sub contractors to avoid inconveniences in future.

The law requires of and edict to be paid for all contract workers (which includes sub contract workers). It does not matter whether the sub contractor agrees or not.
There is also a provision of the principal employer paying the amount under his own code where the contractor is not registered
