I have received a new job offer from an employer, and as a result, I have decided to resign from my current position. I have discussed this with my functional head, but they are not willing to accept my resignation and have provided me with a counteroffer. However, I am not satisfied with the offer they have presented.

Therefore, I have written an email to both the HR manager and my functional head formally tendering my resignation. I am prepared to work for the notice period of one month as per company policy. Despite my decision, my functional head has expressed that they will not approve my resignation.

I would appreciate your advice on how to proceed in this situation and request clarification on the HR terms and conditions regarding resignations.

Hi,

First, write the letter and provide one copy to the functional head and another copy to the HR manager. Then, do the same by sending a soft copy (email). If they are still not ready, file a complaint with the labor commissioner.

Thank you for your response. If I complain to the Labor Commissioner, will it affect my future career or not? I am worried and thinking about this point only. I have a better opportunity with a new employer. I am ready to serve my notice period with full attendance, provide my best productivity, and all. I am a top performer for my team, so they are not ready to lose me. They thought if I miss the opportunity, I will remain in the same position and continue my job. However, I am not interested.

I have only 10 days remaining in my notice period. After that, I only have 5 days to join the new company. Please advise and guide me on how to proceed legally with the HR team.

Hi,

I have initiated my resignation process properly. I wrote the resignation letter and handed it to the functional head. I also discussed it with the team leader, assistant manager, and senior manager. However, they are not willing to accept my resignation. Therefore, I sent an email copying all HR personnel, my functional head, and team leader. Subsequently, I applied for resignation through the HR portal. My functional head pointed out that I applied through the HR portal without obtaining approval, stating that he does not consider it as a formal notice period and does not accept my resignation.

Please advise me on the proper procedure for my relieving from the company.

Hi,

Don't take tension. First, you just need to write a letter to the labor commissioner. It will not affect your career. Inform your prospective employer about this matter. If the labor commissioner does not take action, file an RTI to inquire about the status of your complaint. Go the legal route; nothing will happen. When you are on the side of the law and they are on the wrong side, there is no need to fear.

Hi, when they are not accepting your resign then how could your notice period will start. So don’t wait for anything just write letter to Labour Commissioner.
