Dear seniors,
i had a small confusion as
1.probation period of an employee is 3 months in our company due to less performance we keep on extending his probation,now he completed 15 months and got conformed employee in our organization. whether he is eligible for earned leaves from 15th month onwards or for previous 14 months also it will be calculated ?
2,women worker has completed 80 days of working in an calender year but she is still in probation period only whether we can give maternity benefit to her or not ?
3.Can the probation be upto 1.5 yrs or is thier any limit if so the employee will get the benefits or wait upto conformation permanent employee ?
4.what other benefits can be given to conformed employees.
please guide me in solving this issue

on what reason a confirmed will go for termination whether he has gone /done for theft case or stolen the company's assets then he will be terniminated

leave does not have any concern with probation or confirm employee.Here leave will be calculated from date of joining.leaves are calculated on calendra
year basis.individual earn leave in a calender year than same he entitle to take in next calendewr year.
maternity benefit also does not hae any relation with probation.
period of probation is governed by certified standing orders of company but it should not be more than 240 days as individual becomes confirm after 240 days.there is no difference in legal benefits during probation or confirmation please.

Any employee who has completed 180 days service, automatically becomes eligible for permanent employment. Policy of any organisation to keep on extending probation will not be seen as fair practice neither in the eyes of employee nor in the eyes of law.
If 6 months is not enough for employer/ employee to decide and show that it is worth keeping him or his skills can be useful to organisation or not, than better option is to do away with this employee in training/ probation period.
Thus new employee and its manager's (Mentor) efforts should be closely and objectively monitored in first 3 months, giving them a fair chance to proove their worth for organisation.
