Dear Mrunal,

Thank you for the revised slabs for Maharashtra minimum wage notification-2013.

My query to all is the following:

The minimum wage for Shops and Establishment is as follows:

Zone I

Basic Special Allowance Total

Skilled 5800 + 1576.8 = 7377

Semi Skilled 5400 + 1576.8 = 6977

Unskilled 5000 + 1576.8 = 6577

Kindly clarify - Should the basic salary/wage for all employees, whether executive/technical service staff, be at least the minimum basic as provided above? It was also mentioned that in Maharashtra, HRA (minimum 5% of basic) should also be included. Does that mean all skilled employees will have a gross salary of Rs. 7667, semi-skilled Rs. 7247, and unskilled employees Rs. 6827? The aforementioned gross salaries include 5% HRA.

I am slightly confused as I have come across some companies under shops and establishments having much lower basics - 2500, 3500, etc. Rs. 5800 is on the higher side as beyond this gross amount, the company will incur costs on PF, ESIC, Bonus, etc., which will increase the CTC. According to this calculation, taking a minimum bonus of Rs. 3500, the CTC for employee/technical staff will not be less than Rs. 100,000 approximately.

Am I correct? Please correct me if I am wrong.

If an employee's basic salary is 8800, HRA is 3325, special allowance is 880, TRA is 1375, and PP is 850, the total gross income is 15230. However, if there is a deduction of a loan of Rs. 7600 and other deductions like PT/PF, resulting in a salary of 6500, would the employee fall under the minimum wage act as per the provided slab for an Engineering firm?

Kindly guide.

Dear Hetal,

As per the Minimum Wages Act, the employee's gross salary should be equivalent to or higher than the sum of the basic salary, special allowance, and HRA (5% of basic, applicable in some states) slab provided by the employer. The total gross salary of Rs. 15230/- exceeds the slab provided by the Engineering sector. Moreover, the salary amount you calculate after deductions represents the net salary, while the Minimum Wages Act specifies the gross salary to be paid to skilled, semi-skilled, and unskilled employees in a particular industry.
