Hi, I'm Chitra. Now I'm proceeding to take a license in Form 1. This license is to engage contract labor by the principal employer. I want to know what documents will be attached with Form 1. Please tell me the checklist which the principal employer should keep in mind while giving Form 5 to the contractor.

Hi, Chitra,

As an employer, you have to take registration and not a license under the Contract Labour Act. The license will have to be obtained by the contractor. To register, submit the following documents:

1. Memorandum of articleship of the company.
2. Copy of the agreement with the contractor as well as a copy of the work order issued to the contractor.
3. Copy of the current factory's license to establish that the unit is in existence.
4. Form for registration.

Dear Chitra,

Apart from the Articles of Memorandum and Cover Note (Application on letterhead for Registration), you need to submit the following documents to RDLC:

- Form Number 1: Information of Principal Employer
- Form Number 1 Annexure: Information of Contractors to be engaged
- Authorization letter (If you are dealing with RDLC officials, otherwise they will not entertain you)

Remember not to include any contractor who engages fewer than 20 workers. If your company is engaging Civil contractors, also ensure they are covered under The Building & Other Construction Workers' Welfare Cess Act, 1996, and deposit the cess.

Ajay Morolia
