Dear All,
I am making HR policy for my company. Till now there was not specific policy for weekly off and leave. One employee from my company was applied for 20 days leave and she had 15 days leave balance. the 21st and 22nd day was weekly off (sat & sun). Is she eligible for those weekly off? Can anybody give me all details about leaves and weekly off?

Hi,
You first need to find out whether how many leaves are to be given yearly segregating them into casual leave, sick leave & planned leaves & whether you want to keep the sandwitch leave policy or not? If sandwitch leave concept is not applicable then just count the number of days she was absent as leaves taken & if sandwitch leave concept is there then add the weekly off also as leave.

The employee who has taken 20 days leave, has balance of 15 ELs means 5 will be LWP. This is clear but after 20 days the 21st and 22nd day is sat & sun which is weekly off. So i am confused whether to give this off as a paid or without pay.

If the 21st ans 22nd days are weekly off and if the person happens to take the 23rd day also as an OFF then all three days (21st, 22nd & 23rd days) will be considered as LWP (Leave Without Pay), otherwise if the person is not taking the 23rd leave as a holiday then it would be his/her eligilble leave.

Thanx Vidya, But she was present on 23 rd day and also due to less leave balance her 5 days from leave were LWP. So still she will get those 2 weekly off? Sangeeta

yes, she is eligiable for those two days weekly off. Ex: If weekly of is on sunday employee is taken the leave up to staturday then worked on monday he/she eligiable for sunday off, so you can not make LWP in your case.

If your unit is covered under the Minimum Wages Act. 1948 then after going through Rule 23 it is clear that we are to grant weekly day of rest to the concerned person. If your appropriate Govt. is State Govt. then go through those Rules relating to weekly day of rest before taking final decision in the matter at hand.

When framing the policy, ensure to include the following things also to avoid confusions.
Aoff - Will be working in Sunday but taking Off on Wednesday
Coff - Compensatory Off
Woff for Maint people (those who will compulsorily work in Sundays but take off on weekdays).
