To: Dear Seniors, Can you share with me what is mentioned in the Act or govt guidelines for Casual leave and Sick leave?

If your query is regarding the statutory leave rules applicable to private establishments, then please refer to the Shops and Commercial Establishments Act of your state, if your establishment is a shop or commercial establishments. In case your is a factory, plantation or mine, you can follow the leaves provided under the Factories Act, Plantations Labour Act and Mines act respectively.

Yes sir, we come under Factory Act. So will we get only this type of leave?

1 PL will be eligible after working for 20 days. To avail this leave, it is mandatory to work a total of 240 days in a calendar year.

Yes. That also, your leave will get credited only after one year of service and till then you will not be eligible to have any leave. This is as per law. But in practice there will be settlements between the Management and the Union regarding sick leaves and casual leaves. But this is subject to settlement only and in the absence any such settlements or agreement with the employees, the only leave available is the annual leave with wages which is otherwise called privileged leave or earned leave.

Earned leave above referred is not just credited on every 20 days of work but it is credited yearly in January. An employee who has worked at least for 240 days in the preceding year of 12 months is eligible to get earned leave. At the same time, an employee who has joined during any month of the preceding year shall be given credit of EL pro rata basis if he has worked for 20 days in a month. Accordingly, if the date of joining of an employee falls in the month of June, he should have worked at least for 140 days or if the date of joining falls in September, he should have worked for 80 days in order to be eligible to get earned leave in the current year. For the purpose of eligibility all paid days, ie, weekly off days, holidays, days of lay off, days not worked due to employment injury, would be considered as days worked. The number of leaves that an employee earns shall depend on the physical days worked and it will be one day for every 20 days physically worked.

Casual leave matters are generally provided in the respective 'Standing Orders' of the Factory. Like this PL/EL/SL as well, please refer to it. Many factories may not provide CL option. You may refer Chapter VIII of the Factories Act, 1948 for more details.
